EMRA Antibiotic Guide Contributor Agreement

Thank you for agreeing to write and/or review material (“Contribution”) for the EMRA Antibiotic Guide, a collective work that will become part of the EMRA resource library (“Work”).

Inclusion of the Contribution in the Work is contingent upon acceptance by the Editor-in-Chief. EMRA will own the copyright of the Contribution and all chapters and accompanying materials developed for the Work. EMRA reserves the right to secure an educational grant for the Work and publish it in a variety of formats, including but not limited to print, electronic, and mobile app platforms.

As evidenced by your acceptance of the following terms, you agree:

  • To disclose any institutional or commercial affiliations or associations that might pose a conflict of interest or give the impression of a conflict of interest in connection with the submitted material;
  • To observe Health Insurance Portability and Accountability Act privacy laws;
  • The Contribution is specially commissioned by EMRA for use in the collective Work and shall be considered a work for hire. You acknowledge you will receive no monetary compensation for Contribution. In addition, to the extent the Contribution is held not to be a work made for hire, you assign EMRA your copyright in the Contribution and agree to any additional terms EMRA may reasonably require to perfect the copyright assignment.
  • The Contribution is your original work and is not presently under copyright by any other party or, if under copyright, that written permission to use the material has been obtained and that inclusion and publication of the Contribution will not infringe the copyright of any third party.
  • The primary goal of the Contribution is to educate readers, and all reasonable measures have been taken to ensure the accuracy of the information provided therein.
  • Neither EMRA nor any of its related affiliates, nor their respective officers or employees, shall be held liable for damages or losses resulting from the Contribution. Each Contributor is solely responsible for any damages to another individual or organization for any claims that the Contribution infringes upon the proprietary rights of an individual or entity and will indemnify, save and hold harmless EMRA from any such third-party claims.

EMRA hereby grants and licenses back to Contributor a royalty-free, worldwide limited right to use the Contribution, in whole or in part, as the basis for his/her own further research or spoken presentations, provided such activities reference the overall Work in which the Contribution appears. This license does not include the right for Contributor to transfer, offer for sale, or sell the Contribution to any third party.

I HAVE READ AND UNDERSTAND THE RIGHTS AND RESTRICTIONS SET FORTH IN THIS AGREEMENT.
